These Terms of Service ("Terms") govern your access to and use of the ClaimCash mobile application ("App") provided by Eversight LLC ("Eversight," "we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using ClaimCash, you confirm that you are at least 13 years of age and agree to comply with and be bound by these Terms. If you do not agree to these Terms, you must not use the App.

2. Description of Service

ClaimCash is a mobile application that helps users discover class action lawsuit settlements they may be eligible for and assists them in filing claims. The App provides:

  • A searchable database of active class action settlements
  • Personalized settlement matching based on user profiles
  • Guided claim filing assistance
  • Claim tracking and status updates
  • Alerts for new settlement opportunities

3. Important Disclaimers

ClaimCash is not a law firm and does not provide legal advice. The information provided through the App is for general informational purposes only and should not be construed as legal advice. We do not guarantee that you will qualify for any particular settlement or receive any specific payout amount.

Settlement eligibility is determined solely by the settlement administrators and the courts overseeing each case. ClaimCash facilitates the discovery and filing process but has no control over the approval, denial, or timing of any claim or payout.

4. User Accounts

To use certain features of the App, you may need to create an account. You are responsible for:

  • Providing accurate and complete information
  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use

5. User Obligations

When using ClaimCash, you agree to:

  • Provide truthful and accurate information in your profile and claim submissions
  • Not submit fraudulent or intentionally misleading claims
  • Not use the App for any illegal purpose
  • Not attempt to interfere with or disrupt the App's operation
  • Not reverse engineer, decompile, or disassemble the App
  • Not use automated systems to access the App without permission

6. Subscriptions and Payments

ClaimCash offers both free and premium subscription tiers. For premium subscriptions:

  • Payment is charged to your Apple ID account at confirmation of purchase
  • Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period
  • Your account will be charged for renewal within 24 hours prior to the end of the current period
  • You can manage and cancel your subscriptions in your Apple ID account settings
  • Any unused portion of a free trial period, if offered, will be forfeited upon purchasing a subscription

Refunds are handled by Apple according to their refund policies. We do not process payments directly.

7. Intellectual Property

The App and its original content, features, and functionality are owned by Eversight LLC and are protected by international copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Eversight LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or other intangible losses, resulting from:

  • Your use of or inability to use the App
  • Any claim not being approved by a settlement administrator
  • Any delay or failure in receiving settlement payouts
  • Unauthorized access to your account or data
  • Any errors or inaccuracies in settlement information

9. Indemnification

You agree to indemnify, defend, and hold harmless Eversight LLC, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses arising from your use of the App or violation of these Terms.

10. Termination

We may terminate or suspend your account and access to the App at our sole discretion, without prior notice, for conduct that we believe violates these Terms or is harmful to other users or to Eversight LLC.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law provisions.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms in the App and updating the "Last updated" date. Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms.
